Privacyverklaring — Whose Song?

In deze verklaring lees je welke persoonsgegevens de app Whose Song? gebruikt, waarom, hoe lang ze bewaard worden en welke rechten je hebt. Ze geldt voor de app voor iPhone en Android en voor de pagina's op https://whosesong.beyondbarriers.nl/.
In het kort
- Je hebt geen e-mailadres, wachtwoord of telefoonnummer nodig. De app geeft je telefoon een willekeurig account-ID.
- We bewaren de naam die je kiest, de nummers die je toevoegt en je spellen, en alleen om het spel te laten werken.
- Elk nummer wordt opgezocht in de catalogus van Apple Music. Je voegt nummers op vier manieren toe: met een link naar een openbare Spotify-playlist, met screenshots van een lijst met nummers, door een lijst te plakken die je zelf hebt geëxporteerd, of door te zoeken. Je telefoon leest de openbare pagina van de playlist, screenshots en geplakte lijsten zelf, en screenshots verlaten je telefoon nooit. Alleen per nummer de titel, de artiesten, de plek in de lijst en of het als expliciet is gemarkeerd (bij een playlistlink of een geplakte lijst ook de lengte, en bij een geplakte lijst de code van het nummer, de ISRC, als de lijst die heeft), wat je in de zoekbalk typt en het resultaat dat je kiest, gaan naar onze server, die ze gebruikt om de nummers bij Apple Music op te zoeken zonder iets wat naar jou herleidbaar is. De playlistlink zelf krijgen en bewaren we niet.
- Niemand anders kan je lijst doorbladeren. Je kunt hem zelf bekijken en aanpassen; na een import laat de app eerst alleen zien hoeveel nummers ze vond, zodat het spel je nog kan verrassen. Nummers komen één voor één naar buiten: elk nummer dat speelt, wordt aan iedereen in dat spel onthuld met je naam. De telefoon van de host krijgt het geluidsfragment van elk getrokken nummer, maar niet de titel. Dat geldt ook voor nummers die worden vervangen omdat hun fragment niet geladen kan worden (hooguit 5 per spel) en voor nummers die onafgespeeld blijven als een spel eindigt; zo'n nummer wordt in die lobby nooit opnieuw getrokken.
- Spellen worden na 48 uur verwijderd. Accounts die 180 dagen niet gebruikt zijn, worden verwijderd. Met "Delete my data" in de app wis je alles meteen.
- Geen advertenties, geen tracking, en we verkopen nooit gegevens. We gebruiken geen analytics. De app vraagt geen toestemmingen: screenshots kies je in de eigen fotokiezer van je telefoon, die de app alleen de foto's geeft die je kiest.
- Je telefoon maakt alleen rechtstreeks verbinding met Spotify om de openbare pagina te lezen van een playlistlink die je plakt. Elk fragment is een preview van 30 seconden van Apple Music, die de telefoon van de host van Apple streamt, en ook de hoesafbeeldingen laden de telefoons bij Apple. In de Android-app zit de tekstherkenning van Google (ML Kit), die Google eigen technische meetgegevens stuurt met een ID per installatie, maar geen afbeeldingen en geen tekst. Whose Song? is niet verbonden aan Spotify of Apple.
1. Wie is verantwoordelijk

We hebben geen functionaris voor gegevensbescherming aangesteld, omdat de wet dat voor ons niet verplicht.
2. Welke gegevens we gebruiken
Account-ID en sessie. Zodra je voorbij het eerste scherm gaat, meldt de app je aan met een willekeurig account-ID. Er komt geen e-mailadres, wachtwoord of telefoonnummer aan te pas. Het ID is gepseudonimiseerd, niet anoniem: alles hieronder is eraan gekoppeld, dus behandelen we het als persoonsgegeven. Op je telefoon staat een sessiesleutel, zodat je ingelogd blijft. De app toont dit ID als je player ID onder Privacy & data op het startscherm.
Je naam. De schermnaam die je kiest (1 tot 24 tekens). Die wordt bij je account bewaard en gekopieerd naar elk spel waaraan je meedoet. Onze server haalt er onzichtbare tekens, stuurtekens en overbodige spaties uit, en weigert een naam met een grof scheldwoord of een grove vloek in het Engels of Nederlands. Heeft iemand in een spel waaraan je gaat meedoen al dezelfde naam, dan krijgt jouw naam in dat spel een nummer (bijvoorbeeld "Sam 2"). Pas je je naam aan, dan houden spellen die al begonnen zijn de oude naam tot ze verwijderd worden.
Je nummers. Elk nummer dat je toevoegt, wordt opgezocht in de catalogus van Apple Music. Er zijn vier manieren om nummers toe te voegen, en je kunt ze combineren:
- Met een link naar een Spotify-playlist. Je plakt een link naar een openbare Spotify-playlist. Je telefoon leest de openbare Spotify-pagina van die playlist en haalt daar voor de eerste 40 nummers, in de volgorde van de playlist, alleen per nummer de titel, de artiesten, de plek in de lijst, of het als expliciet is gemarkeerd en de lengte uit. Alleen die gegevens stuurt hij naar onze server. De link zelf, het Spotify-ID en de naam van de playlist en al het andere op die pagina (bij een playlist die je zelf hebt gemaakt ook je Spotify-profielnaam) blijven op je telefoon en worden niet bewaard. We krijgen en bewaren geen Spotify-ID's, fragmenten of afbeeldingen.
- Met screenshots. Je opent een lijst met je nummers in je muziekapp, maakt 2 tot 4 screenshots terwijl je scrolt, en kiest ze (hooguit 6) in de eigen fotokiezer van je telefoon. De app krijgt alleen de foto's die je kiest. Ze leest de tekst erin op je telefoon zelf: op de iPhone met de ingebouwde tekstherkenning van Apple, op Android met Google ML Kit, dat in de app is ingebouwd (zie paragraaf 5). De afbeeldingen worden nooit geüpload, niet naar ons en niet naar iemand anders. De app wist haar eigen kopieën zodra ze gelezen zijn; de screenshots in je fotobibliotheek blijven zoals ze zijn. Daarna stuurt de app onze server alleen wat ze per nummer heeft gelezen: de titel, de artiesten, de plek in de lijst en of het nummer als expliciet was gemarkeerd.
- Door een lijst te plakken. Je plakt in de app een lijst met nummers die je zelf hebt gekopieerd of geëxporteerd, één nummer per regel of als tabel (CSV). De app leest die op je telefoon en stuurt onze server per nummer alleen de titel, de artiesten, de plek in de lijst, of de lijst het als expliciet markeert en, als de lijst die heeft, de ISRC (een internationale code voor een opname) en de lengte van het nummer. Dat zijn maximaal 40 nummers, in de volgorde van de lijst. Al het andere in de tekst die je plakt, blijft op je telefoon en wordt niet bewaard.
- Door te zoeken. Je typt de naam van een nummer of artiest. De app stuurt wat je typt naar onze server, die er de catalogus van Apple Music mee doorzoekt en maximaal 8 nummers terugstuurt. Tik je er een aan, dan zoekt onze server dat nummer opnieuw op bij Apple en zet het in je nieuwste lijst (of begint een nieuwe als je er nog geen hebt). We bewaren niet wat je typt.
Behalve om de pagina van een playlistlink te lezen die je plakt, maakt de app geen verbinding met Spotify. Onze server zoekt de nummers op in de catalogus van Apple Music (zie Apple in paragraaf 5). Per gevonden nummer (maximaal 40 in je lijst) bewaren we: het song-ID van Apple, de ISRC van het nummer, de titel en artiesten volgens Apple, de plek in je lijst, de lengte volgens Apple, of Apple er een fragment van heeft, de webadressen van het nummer op Apple Music en van de hoesafbeelding, het land van de Apple Music-winkel waarin is gezocht (voorlopig Nederland) en hoe de lijst is gemaakt (screenshots, een lijst of zoeken; een playlistlink telt als een lijst). Dat is gekoppeld aan je account-ID. We bewaren alleen je nieuwste import, tenzij een spel waarin je zit nog een oudere gebruikt. Nummers die niet gevonden worden, vallen af. Een lengte die je telefoon meestuurt, gebruikt onze server alleen om een kort nummer te onderscheiden van een fragmentje of beltoon, en die bewaart hij niet.
We bewaren geen playlistlink, geen screenshots, geen tekst die je plakt of typt, geen audio, afbeeldingen of webadressen van fragmenten: de telefoon van de host vraagt elke ronde een vers fragment op. Afgezien van de zoekcache hieronder, die aan niemand gekoppeld is, bewaren we de tekst die de app las niet.
Oudere testversies. Testversies van de app van vóór de release in de winkels, die nooit in de App Store of Google Play hebben gestaan, werkten anders bij een Spotify-link: ze bewaarden het Spotify-ID en de naam van de playlist en, voor maximaal 100 nummers, per nummer het Spotify-ID, de titel, de artiesten, de plek, de lengte en het webadres van het fragment van 30 seconden bij Spotify, en ze speelden die fragmenten af en toonden hoesafbeeldingen van de servers van Spotify. Zolang zo'n versie nog gebruikt wordt, neemt onze server haar imports nog aan. Die worden bewaard en gewist volgens dezelfde regels als elke andere lijst (paragraaf 7), en "Delete my data" wist ze ook. Host zo'n versie een spel waaraan je met de huidige app meedoet, dan toont de onthulling van zo'n nummer een link "Open in Spotify", zonder hoesafbeelding; tik je erop, dan ga je naar de app of website van Spotify, waar de voorwaarden van Spotify gelden.
Je lijst bekijken en aanpassen. Alleen jij kunt je eigen lijst zien. Om de verrassing te bewaren, laat de app direct na een import (een playlistlink, screenshots of een geplakte lijst) alleen zien hoeveel nummers ze vond; nummers die je door te zoeken toevoegt, zie je meteen terwijl je ze toevoegt. Je lijst zelf staat onder My songs op het startscherm: daar zie je haar (titels, artiesten en kleine hoesafbeeldingen), haal je nummers weg of zoek je nummers die ontbreken (zie "Door te zoeken" hierboven). Een nummer weghalen wist het meteen uit je nieuwste lijst. Een spel dat al bezig is, houdt de lijst waarmee het begon; die kopie wordt daarna gewist zoals een oudere import (paragraaf 7). Kijken haalt een deel van de verrassing weg; daarom laat de app de lijst alleen zien als je haar opent.
Zoekcache voor nummers. Zodat hetzelfde nummer niet bij elke import opnieuw bij Apple wordt opgezocht, bewaart onze server die opzoekingen en hun resultaten: de titel en artiesten zoals opgezocht (vereenvoudigd, bijvoorbeeld zonder hoofdletters en accenten) met de ISRC als de lijst die had, of het nummer als expliciet was gemarkeerd, of de meegestuurde lengte korter was dan een minuut, het land van de winkel, en wat Apple teruggaf. Wat je in de zoekbalk typt, komt niet in deze cache. De cache is aan geen enkele speler of account gekoppeld en bevat geen persoonsgegevens.
Limieten op nummers toevoegen. Om onze gedeelde verbinding met Apple tegen misbruik te beschermen, legt onze server je account-ID, het tijdstip en het soort vast van elke poging om nummers toe te voegen (een import uit een playlistlink, screenshots of een geplakte lijst, een zoekopdracht, of één nummer toevoegen), en weigert hij meer dan 4 imports, 30 zoekopdrachten of 20 toegevoegde nummers per minuut.
Wat we kunnen uitzetten. We kunnen de Spotify-playlistlink, het toevoegen van nummers uit de catalogus van Apple Music (alle vier de manieren samen) en de fragmenten van Apple op elk moment op onze server aan- of uitzetten, zonder app-update. Staat het toevoegen van nummers uit, dan biedt de app het niet aan, leest ze geen playlistpagina's of screenshots en zoekt onze server niets voor je op bij Apple. Staan de fragmenten van Apple uit, dan worden er geen nummers afgespeeld. Iets uitzetten wist geen nummers die je al hebt toegevoegd; in paragraaf 7 staat wanneer die gewist worden.
Spelgegevens. De spellen die je host of waaraan je meedoet: de spelcode, wie de host is, wie er meedoen, welk nummer er per ronde langskwam en van wie het was, welke nummers, en van wie, werden vervangen omdat hun fragment niet geladen kon worden of onafgespeeld bleven toen een spel eindigde of van host wisselde, op wie je gokte, hoe snel je antwoordde, je punten en je score. Als een host je uit een spel verwijdert, leggen we dat vast, zodat je niet opnieuw in dat spel kunt.
Wanneer je de app voor het laatst gebruikte. De datum waarop je app voor het laatst verbinding maakte, zodat we accounts kunnen verwijderen die niet meer gebruikt worden.
Technische gegevens. Als je telefoon verbinding maakt met onze servers, verwerken onze hostingpartij Supabase en haar netwerkpartij Cloudflare je IP-adres, gegevens over je toestel en de app (de "user agent") en de tijdstippen van je verzoeken. De aanmeldservice van Supabase bewaart het IP-adres en de toestelgegevens van je huidige sessie bij je account, en schrijft elke aanmeldgebeurtenis (zoals inloggen en het verlengen van je sessie) met het IP-adres in een auditlog.
Berichten aan ons. Als je ons mailt: je e-mailadres, je bericht en wat je verder meestuurt, zoals je player ID.
Alleen op je telefoon. De app bewaart je sessiesleutel, je naam, de code van je laatste spel (voor de knop "Rejoin") en de manier waarop je de laatste keer nummers toevoegde in haar eigen opslag op je telefoon. Dat wordt gewist als je "Delete my data" gebruikt of de app verwijdert. Als je screenshots kiest, geeft de fotokiezer de app kopieën ervan, die de app wist zodra ze gelezen zijn. Tekst die je plakt, staat alleen in het geheugen van de app zolang dat scherm open is. De app gebruikt geen advertentie-ID en slaat geen trackingcookies op. Cloudflare kan een kortlevende beveiligingscookie (__cf_bm, 30 minuten) plaatsen om onze servers tegen bots te beschermen. Die cookie is strikt noodzakelijk voor de dienst.
Wat we niet verzamelen. Geen e-mailadres, telefoonnummer, wachtwoord, contacten, locatie, foto's, microfoongeluid of advertentie-ID, en niets uit je Spotify- of Apple-account. Screenshots die je kiest, worden op je telefoon gelezen en komen nooit bij ons. Van de pagina van een playlist en van een lijst die je plakt komen alleen de titels, artiesten, plekken in de lijst, markeringen als expliciet en, als de bron die heeft, lengtes en ISRC's bij ons, nooit de link of de rest van de tekst. De app heeft helemaal geen toegang tot je Spotify-account of je Apple Music-account. Er zitten geen analytics-, advertentie-, crashrapportage- of trackingtools van ons in de app. Het enige ingebouwde onderdeel dat iets aan zijn maker meldt, is Google ML Kit in de Android-app (paragraaf 5).
3. Waarom we ze gebruiken, en op welke grondslag
- Het spel laten werken (account-ID, naam, de nummers die je met een playlistlink, uit screenshots, uit een geplakte lijst of door te zoeken toevoegt, wat je in de zoekbalk typt, spelgegevens, datum van laatste gebruik). Dit is nodig om het spel te leveren waar je om vraagt, volgens onze gebruiksvoorwaarden: AVG artikel 6 lid 1 sub b.
- Beveiliging en misbruik voorkomen (technische gegevens, grenzen aan hoe vaak je kunt importeren of hosten, de limieten op nummers toevoegen, namen met grove scheldwoorden of vloeken weigeren, spelers uit een spel verwijderen, meldingen afhandelen en gegevens wissen die niet meer gebruikt worden). Dit is gebaseerd op ons gerechtvaardigd belang om de dienst veilig, werkend en vrij van misbruik te houden: artikel 6 lid 1 sub f. We gebruiken daarvoor zo weinig mogelijk gegevens en bewaren ze kort.
- Google ML Kit in de Android-app (zie paragraaf 5). Screenshots op de telefoon zelf lezen, in plaats van ze te uploaden, houdt je afbeeldingen privé. De meetgegevens van ML Kit horen bij hoe Google het aanbiedt. Voor zover wij ervoor verantwoordelijk zijn, is dit gebaseerd op ons gerechtvaardigd belang om die mogelijkheid op het toestel aan te bieden: artikel 6 lid 1 sub f. Google is verantwoordelijk voor zijn eigen gebruik van de meetgegevens. ML Kit is onderdeel van de Android-app, dus Google kan ze ook krijgen als je de screenshots nooit gebruikt, en de app heeft geen instelling om ze uit te zetten.
- App-updates (zie Expo in paragraaf 5). Dit is gebaseerd op ons gerechtvaardigd belang om foutoplossingen en beveiligingsupdates snel te leveren: artikel 6 lid 1 sub f.
- Je berichten en verzoeken beantwoorden. Dit is gebaseerd op ons gerechtvaardigd belang om je te helpen (artikel 6 lid 1 sub f) en op onze wettelijke plicht om privacyverzoeken te beantwoorden (artikel 6 lid 1 sub c).
We vragen voor niets hiervan om toestemming, omdat niets hiervan op toestemming berust. We gebruiken je gegevens niet voor advertenties of profilering en verkopen ze nooit. We nemen geen geautomatiseerde besluiten met rechtsgevolgen of vergelijkbare gevolgen voor je. Het opzoeken van nummers bij Apple Music gaat automatisch, maar dat bepaalt alleen welke nummers in je lijst komen, en je kunt het verbeteren onder My songs.
Je bent niet wettelijk verplicht ons gegevens te geven. Zonder naam kun je niet spelen. Zonder eigen nummers kun je wel meedoen en gokken, maar komen er geen nummers van jou langs.
4. Wie ziet wat
- Jij ziet je naam, je player ID en je eigen lijst. Direct na een import laat de app je alleen zien hoeveel nummers ze vond, zodat ook je eigen nummers je nog kunnen verrassen; onder My songs kun je de lijst zien, nummers weghalen en ontbrekende toevoegen (paragraaf 8).
- Andere spelers in je spel zien je naam en je score. Na elke onthulling zien ze op wie je gokte en hoeveel punten je kreeg. Elk nummer dat speelt, wordt aan iedereen in dat spel onthuld samen met je naam: titel, artiest, de hoesafbeelding van Apple en een link naar het nummer op Apple Music.
- De telefoon van de host krijgt het fragment van elk getrokken nummer, vlak voordat het speelt, zodat hij het hardop kan afspelen. Hij vraagt het fragment aan onze server, die er een vers exemplaar voor ophaalt bij Apple en alleen het adres en de lengte van het fragment doorgeeft. Titel, artiest, hoesafbeelding en link naar het nummer krijgt de telefoon van de host niet vóór de onthulling: die ziet de host bij de onthulling, net als iedereen. Terwijl een fragment speelt, toont de app alleen de regel "Preview from Apple Music".
- Niemand anders kan je lijst doorbladeren, andere spelers niet en de host ook niet. Regels in de database op de server zorgen daarvoor, en ze houden de titel en artiest van elk nummer voor elke telefoon verborgen, ook voor die van de host, tot dat nummer onthuld wordt. Nummers komen één voor één naar buiten: elk nummer dat speelt, wordt aan iedereen in dat spel onthuld met je naam. De telefoon van de host krijgt het geluidsfragment van elk getrokken nummer, maar niet de titel. Dat geldt ook voor nummers die worden vervangen omdat hun fragment niet geladen kan worden (hooguit 5 per spel) en voor nummers die onafgespeeld blijven als een spel eindigt; zo'n nummer wordt in die lobby nooit opnieuw getrokken. Alleen nummers die bij jou hoger in de lijst staan dan bij iedereen anders in het spel kunnen langskomen.
- rezasolutions heeft als beheerder toegang tot de database, om de dienst te laten draaien, verzoeken en meldingen te beantwoorden en problemen op te lossen.
5. Dienstverleners en andere ontvangers
Supabase (onze verwerker). Supabase verzorgt onze database, het aanmelden en de spellogica op de server, ook de serverfuncties die nummers bij Apple Music opzoeken en de telefoon van de host het fragment van elke ronde geven. Ons contract is met Supabase Pte. Ltd., Singapore, en onze verwerkersovereenkomst maakt deel uit van de voorwaarden van Supabase. De gegevens staan in de Europese Unie, bij Amazon Web Services in Ierland (regio eu-west-1). De serverfuncties voor Apple Music draaien in het datacenter van Supabase dat het dichtst bij de telefoon ligt die ze gebruikt (in Europa een Europees datacenter) en slaan wat ze vinden op in die database. Het netwerkverkeer loopt via Cloudflare. Tot de subverwerkers van Supabase horen Amazon Web Services en Cloudflare. Privacybeleid van Supabase: https://supabase.com/privacy
Expo (onze verwerker). Als de app start, vraagt hij bij de updatedienst van Expo of er een nieuwere versie is. Expo (650 Industries, Inc., Verenigde Staten) ontvangt dan je IP-adres, het platform van je telefoon, de app-versie en een willekeurig ID voor deze installatie. Expo krijgt geen naam, playlist of spelgegevens. Privacybeleid van Expo: https://expo.dev/privacy
Spotify (zelfstandig verwerkingsverantwoordelijke). Alleen als je nummers toevoegt met een link naar een Spotify-playlist, maakt je telefoon verbinding met Spotify: met open.spotify.com, om de openbare pagina van de playlist te lezen, en als je een korte link plakt met spotify.link en spotify.app.link (de dienst voor korte links van Spotify, die Branch voor Spotify verzorgt). Spotify ontvangt daarbij je IP-adres, toestelgegevens en welke playlist wordt opgevraagd, en gebruikt dat volgens zijn eigen privacybeleid: https://www.spotify.com/legal/privacy-policy/. De app stuurt bij deze verzoeken geen cookies mee, gebruikt geen Spotify-account of de ontwikkelaars-API van Spotify en heeft geen toegang tot je Spotify-account. Ze laadt geen fragmenten of afbeeldingen van Spotify.
Apple. Whose Song? gebruikt de catalogus en de fragmenten van Apple Music voor elk nummer, op twee manieren:
- Nummers opzoeken. Onze server stuurt de catalogusdienst van Apple (de Apple Music API, die we gebruiken onder onze ontwikkelaarsovereenkomst met Apple Inc., Verenigde Staten) de titels en artiesten die de app van een playlistpagina of screenshots las of die je plakte, de ISRC's uit een geplakte lijst en wat je in de zoekbalk typt, om de nummers te vinden; het song-ID van Apple van een nummer dat je toevoegt, om het te controleren; en in elke ronde het song-ID van Apple van het getrokken nummer, om een vers fragment op te halen. Deze verzoeken komen van onze server, niet van je telefoon, en bevatten geen naam, account-ID, IP-adres of iets anders waarmee jij of je telefoon herkend kan worden. Apple krijgt hierbij dus geen persoonsgegevens van ons en is niet onze verwerker.
- Fragmenten en afbeeldingen. De telefoon van de host streamt het fragment van 30 seconden van elk nummer rechtstreeks van de servers van Apple (audio-ssl.itunes.apple.com). Hoesafbeeldingen komen van de servers van Apple (mzstatic.com): bij elke onthulling op de telefoon van elke speler, en op je eigen telefoon als die zoekresultaten of je lijst onder My songs toont. Apple ontvangt daarbij het IP-adres van die telefoon, toestelgegevens en welk fragment of welke afbeelding wordt opgevraagd, en gebruikt dat als zelfstandig verwerkingsverantwoordelijke volgens zijn eigen privacybeleid: https://www.apple.com/legal/privacy/. Voor mensen in de Europese Economische Ruimte, het Verenigd Koninkrijk en Zwitserland is dat Apple Distribution International Limited, Ierland; elders het Apple-bedrijf dat dat beleid voor jouw land noemt. De app stuurt bij deze verzoeken geen cookies of accountgegevens mee. Je hebt geen Apple-account of Apple Music-abonnement nodig.
- Tik je op "Listen on Apple Music", dan ga je naar de app of website van Apple Music, waar de voorwaarden van Apple gelden.
Google ML Kit (alleen Android, zelfstandig verwerkingsverantwoordelijke). Op Android leest de app screenshots met Google ML Kit, een onderdeel voor tekstherkenning van Google dat op de telefoon draait. De app laat het alleen de screenshots lezen die je kiest, maar ML Kit is onderdeel van de Android-app, en de bibliotheek kan starten zodra de app start, of je nu screenshots gebruikt of niet. Volgens Google verwerkt ML Kit de afbeeldingen en de tekst erin volledig op de telefoon en stuurt het die niet naar Google. ML Kit stuurt Google wel eigen technische meetgegevens over het gebruik, voor diagnose en gebruiksanalyse: toestelgegevens (zoals merk, model, Android-versie en beschikbare ML-hardware), de naam en versie van de app, een ID per installatie waarvan Google zegt dat het niet bedoeld is om een gebruiker of toestel te herkennen, prestatiecijfers (zoals hoe lang het lezen duurde), het formaat en de grootte van de afbeelding, de grootte van wat erin ging en eruit kwam, de versie van ML Kit, het soort gebeurtenis (zoals opstarten, tekst lezen of afsluiten) en foutcodes. Zoals bij elke verbinding ziet Google daarbij ook het IP-adres van je telefoon. Google versleutelt de meetgegevens onderweg, zegt ze niet aan derden door te geven, en gebruikt ze om ML Kit te meten, fouten op te sporen, te onderhouden en te verbeteren en om misbruik op te sporen. Google is verantwoordelijk voor dat gebruik volgens zijn eigen privacybeleid: https://policies.google.com/privacy. Dat beleid noemt Google Ireland Limited, Ierland, als verwerkingsverantwoordelijke voor mensen in de Europese Economische Ruimte en Zwitserland. Wij krijgen deze meetgegevens niet. Op de iPhone gebruikt de app de ingebouwde tekstherkenning van Apple, die volledig op de telefoon werkt.
Onze e-mailprovider (verwerker). Als je ons mailt, wordt je bericht bewaard door de aanbieder van onze mailbox, die het namens ons verwerkt.
Appwinkels: Apple en Google (zelfstandig verwerkingsverantwoordelijken). Je downloadt de app via de App Store of Google Play, onder hun eigen voorwaarden en privacybeleid. Als je dat in de instellingen van je telefoon hebt toegestaan, kunnen zij ons algemene statistieken en crashrapporten geven. Daar staan je naam en je nummers niet in.
Verder niemand. We verkopen of verhuren geen gegevens en geven ze niet aan adverteerders of databrokers. We geven alleen gegevens aan anderen als de wet dat verplicht, bijvoorbeeld door een rechterlijk bevel.
6. Doorgifte buiten de Europese Unie
De database staat in Ierland. Supabase Pte. Ltd. zit in Singapore, en voor Singapore bestaat geen adequaatheidsbesluit van de EU. De subverwerkers van Supabase, Amazon Web Services en Cloudflare, en Expo zitten in de Verenigde Staten. Deze doorgiften zijn beschermd met de Europese modelcontractbepalingen (Standard Contractual Clauses, besluit (EU) 2021/914 van de Europese Commissie) in de verwerkersvoorwaarden van Supabase en Expo en, voor Amerikaanse bedrijven die daaronder gecertificeerd zijn, het EU-VS Data Privacy Framework. Je kunt ons om een kopie van deze waarborgen vragen. De verwerkersovereenkomst van Supabase staat op https://supabase.com/legal/dpa
De zoekopdrachten van onze server bij Apple Inc. in de Verenigde Staten bevatten geen persoonsgegevens (paragraaf 5). Voor mensen in de Europese Economische Ruimte valt wat Apple ontvangt als een telefoon een fragment of afbeelding laadt onder Apple Distribution International Limited in Ierland. Gebruik je de app buiten Europa, dan kunnen de serverfuncties voor Apple Music in een datacenter van Supabase buiten de EU draaien, met dezelfde waarborgen als hierboven. Google kan de meetgegevens van ML Kit in de Verenigde Staten verwerken; Google LLC is gecertificeerd onder het EU-VS Data Privacy Framework.
7. Hoe lang we gegevens bewaren
- Oudere imports (via een playlistlink, uit screenshots of een geplakte lijst, of begonnen met zoeken): verwijderd zodra je opnieuw importeert, tenzij een spel waarin je zit ze nog gebruikt — dan uiterlijk een dag nadat je dat spel verlaat of eruit gezet wordt, of nadat het wordt verwijderd.
- Je account, naam en nieuwste import: bewaard tot je ze zelf wist, of tot je app 180 dagen geen verbinding heeft gemaakt. Dan worden ze automatisch verwijderd, samen met al het andere dat aan je account gekoppeld is.
- Spellen (code, spelers, de namen die erin gekopieerd zijn, rondes, nummers die werden vervangen omdat hun fragment niet geladen kon worden of die onafgespeeld bleven toen een spel eindigde of van host wisselde, gokken, scores en verwijderingen): verwijderd 48 uur nadat het spel is aangemaakt.
- Limietgegevens (account-ID, tijdstip en soort van elke import, zoekopdracht of toegevoegd nummer, voor de limieten op nummers toevoegen): verwijderd na 1 uur.
- Zoekcache voor nummers (aan niemand gekoppeld): verwijderd 90 dagen na de zoekopdracht.
- Screenshots: nooit op onze servers. De kopieën van de app op je telefoon worden gewist zodra ze gelezen zijn.
- Playlistlinks, geplakte tekst en zoekopdrachten: nooit opgeslagen op onze servers. Alleen de nummers die gevonden worden, bewaren we, als deel van je lijst.
- Aanmeldingen zonder speler (bijvoorbeeld als het instellen niet werd afgerond): verwijderd na 7 dagen.
- Auditlog van aanmeldingen (aanmeldgebeurtenissen met IP-adres en tijdstippen): na 7 dagen verwijderd door de dagelijkse opschoning.
- Sessiegegevens van aanmeldingen (IP-adres en toestelgegevens van je sessie): bewaard zolang je sessie bestaat, en verwijderd samen met je account.
- Serverlogs bij Supabase (IP-adres, toestelgegevens, tijdstippen): Supabase bewaart ze ongeveer één dag.
- Updatecontroles bij Expo: Expo bewaart ze alleen zo lang als nodig is om de updatedienst te laten werken en te beveiligen.
- E-mails aan ons: bewaard zolang nodig is om je bericht af te handelen, en niet langer dan 12 maanden nadat het is afgerond.
- Gegevens op je telefoon: tot je "Delete my data" gebruikt of de app verwijdert.
De automatische opschoning draait één keer per dag, en voor limietgegevens elk uur. Het wissen kan dus tot een dag (voor limietgegevens tot een uur) na de termijnen hierboven plaatsvinden.
8. Je rechten
Je hebt het recht om je gegevens in te zien (AVG artikel 15), te laten verbeteren (artikel 16) of te laten wissen (artikel 17), het gebruik ervan te laten beperken (artikel 18), ze in een machineleesbaar formaat te krijgen (artikel 20) en bezwaar te maken tegen gebruik op basis van ons gerechtvaardigd belang (artikel 21).
Zo gebruik je ze:
- Alles wissen: open op het startscherm Privacy & data en tik op Delete my data. Daarmee worden je account, naam, de nummers die je hebt toegevoegd en je deel in elk spel meteen gewist. Spellen die jij host, stoppen voor iedereen.
- Je naam aanpassen: tik bovenaan het startscherm op je naam.
- Je nummers bekijken en verbeteren: tik op het startscherm op My songs om je lijst te zien. Daar haal je nummers weg met het ✕ of voeg je ontbrekende toe. Je kunt ons ook om een kopie mailen.
- Al het andere, of als je de app niet meer hebt: mail naar admin@beyondbarriers.nl en vermeld het player ID dat onder Privacy & data staat. Heb je de app al verwijderd? Vertel ons dan de naam die je gebruikte, een paar nummers die je toevoegde en ongeveer wanneer je speelde; dan proberen we je gegevens te vinden. We kunnen om extra gegevens vragen om te controleren dat het verzoek echt van jou komt. We antwoorden binnen een maand. Is een verzoek ingewikkeld, dan kunnen we twee maanden extra nodig hebben; dat laten we je dan weten. Het is gratis.
- Klachten: je kunt een klacht indienen bij de Autoriteit Persoonsgegevens (https://autoriteitpersoonsgegevens.nl) of bij de toezichthouder in het EU-land waar je woont of werkt. We stellen het op prijs als je eerst contact met ons opneemt, zodat we kunnen proberen het op te lossen.
9. Kinderen
Je moet 16 jaar of ouder zijn om Whose Song? te gebruiken, of toestemming hebben van een ouder of voogd als je jonger bent. Denkt een ouder of voogd dat zijn of haar kind de app zonder toestemming heeft gebruikt, dan kan die ons mailen met het player ID (of de naam die het kind gebruikte en ongeveer wanneer), en dan wissen we de gegevens.
10. Beveiliging
Alle verbindingen zijn versleuteld (HTTPS). Regels in de database (row-level security) zorgen ervoor dat elke telefoon alleen kan lezen wat hij mag zien, en alle spellogica en puntentelling draaien op de server, niet op de telefoons. Nummers kunnen alleen door onze server worden opgeslagen, die elk nummer zelf bij Apple opzoekt, en onze ontwikkelaarssleutel van Apple staat alleen daar. Er zijn geen wachtwoorden die kunnen uitlekken. Alleen rezasolutions heeft beheerderstoegang. Wie je ontgrendelde telefoon heeft, kan de app als jou gebruiken. Bij een datalek nemen we de stappen die de wet voorschrijft, waaronder een melding aan de Autoriteit Persoonsgegevens en, als dat nodig is, aan jou.
11. Toestemmingen op je telefoon
De app vraagt geen toestemmingen: geen microfoon, camera, locatie, contacten, fotobibliotheek of meldingen. Voeg je nummers uit screenshots toe, dan kies je ze in de eigen fotokiezer van je telefoon. Daar is geen toestemming voor nodig: de app krijgt alleen de foto's die je kiest, niet de rest van je foto's. Op Android gebruikt hij alleen gewone rechten die bij de installatie automatisch worden verleend: internettoegang, de netwerkstatus (om te zien of er verbinding is) en de geluidsinstellingen (om de fragmenten af te spelen). Geluid speelt alleen zolang de app open is.

De datum bovenaan geeft de huidige versie aan. Belangrijke wijzigingen kondigen we vooraf aan in de app of op deze pagina. Eerdere versies krijg je op verzoek.

Privacy Policy — Whose Song?

This policy explains which personal data the Whose Song? app uses, why, how long it is kept and what your rights are. It covers the app for iPhone and Android and the pages at https://whosesong.beyondbarriers.nl/.
In short
- You do not need an email address, password or phone number. The app gives your phone a random account ID.
- We store the name you choose, the songs you add and your games, only to run the game.
- Every song is found in Apple Music's catalogue. You add songs in four ways: with a link to a public Spotify playlist, from screenshots of a song list, by pasting a song list you exported yourself, or by searching. Your phone reads the playlist's public page, screenshots and pasted lists itself, and screenshots never leave your phone. Only each song's title, artists, position and whether it is marked explicit (from a playlist link or a pasted list also its length, and from a pasted list its song code, or ISRC, if the list has them), what you type in the search and the result you pick go to our server, which uses them to look the songs up at Apple Music without anything that identifies you. We do not receive or store the playlist link.
- Nobody else can browse your list. You can look at it and edit it yourself under My songs; right after an import the app shows only how many songs it found, so the game can still surprise you. Songs come out one at a time: each song that plays is revealed to everyone in that game with your name. The host's phone receives the audio clip of each drawn song, but not its title. That includes songs that are replaced because their clip cannot be loaded (at most 5 per game) and songs left unplayed when a game ends; such a song is never drawn again in that lobby.
- Games are deleted after 48 hours. Accounts that are not used for 180 days are deleted. "Delete my data" in the app deletes everything straight away.
- No ads, no tracking, and we never sell data. We use no analytics. The app asks for no permissions: screenshots are picked in your phone's own photo picker, which gives the app only the pictures you pick.
- Your phone connects directly to Spotify only to read the public page of a playlist link you paste. Every song clip is a 30-second Apple Music preview that the host's phone streams from Apple, and the phones load the song artwork from Apple too. The Android app includes Google's text recognition (ML Kit), which sends Google its own technical metrics with a per-installation identifier, but no pictures and no text. Whose Song? is not affiliated with Spotify or Apple.
1. Who is responsible
rezasolutions, the Netherlands, is the controller for the personal data described in this policy.

We have not appointed a data protection officer, because the law does not require one for us.
2. Which data we use
Account ID and session. When you continue past the first screen, the app signs you in with a random account ID. There is no email address, password or phone number. The ID is pseudonymous rather than anonymous: everything below is linked to it, so we treat it as personal data. A session token is kept on your phone so you stay signed in. The app shows this ID as your player ID under Privacy & data on the home screen.
Your name. The display name you choose (1 to 24 characters). It is stored with your account and copied into every game you join. Our server removes invisible and control characters and extra spaces from it, and refuses a name that contains a slur or a strong swear word in English or Dutch. If someone already in a game you join uses the same name, yours gets a number in that game (for example "Sam 2"). If you change your name, games that have already started keep the old name until they are deleted.
Your songs. Every song you add is looked up in Apple Music's catalogue. There are four ways to add songs, and you can combine them:
- With a Spotify playlist link. You paste a link to a public Spotify playlist. Your phone reads Spotify's public page for that playlist and takes from it, for the first 40 songs in the playlist's order, only each song's title, artists, position in the list, whether it is marked explicit and its length. It sends our server only those details. The link itself, the playlist's Spotify ID and name, and anything else on that page (for a playlist you made yourself, that includes your Spotify profile name) stay on your phone and are not kept. We do not receive or store any Spotify IDs, clips or artwork.
- From screenshots. You open a list of your songs in your music app, take 2 to 4 screenshots while you scroll, and pick them (at most 6) in your phone's own photo picker. The app receives only the pictures you pick. It reads the text in them on your phone itself: on iPhone with Apple's built-in text recognition, on Android with Google ML Kit, which is built into the app (see section 5). The pictures are never uploaded, not to us and not to anyone else. The app deletes its own copies as soon as it has read them; the screenshots in your photo library stay as they are. The app then sends our server only what it read for each song: the title, the artists, its position in the list and whether it was marked explicit.
- By pasting a list. You paste a list of songs that you copied or exported yourself into the app, one song per line or as a table (CSV). The app reads it on your phone and sends our server only, for each song: the title, the artists, its position in the list, whether the list marks it explicit and, if the list has them, the ISRC (an international code for a recording) and the song's length. That is at most 40 songs, in the list's order. Everything else in the text you paste stays on your phone and is not kept.
- By searching. You type the name of a song or artist. The app sends what you type to our server, which searches Apple Music's catalogue with it and sends back up to 8 songs. When you tap one, our server looks that song up at Apple again and adds it to your newest list (or starts a new one if you have none). We do not store what you type.
Apart from reading the page of a playlist link you paste, the app does not contact Spotify. Our server looks the songs up in Apple Music's catalogue (see Apple in section 5). For each song it finds (up to 40 in your list) we store: Apple's song ID, the song's ISRC, Apple's title and artists, its position in your list, Apple's length for it, whether Apple has a preview clip, and the web addresses of the song on Apple Music and of its artwork, plus the Apple Music store country that was searched (the Netherlands for now) and how the list was made (screenshots, a list, or search; a playlist link counts as a list). This is linked to your account ID. Only your newest import is kept, unless a game you are in still uses an older one. Songs that are not found are dropped. Our server uses a length your phone sends only to tell a short song from a snippet or ringtone, and does not store it.
We do not store the playlist link, your screenshots, the text you paste or type, audio, artwork or clip addresses: the host's phone asks for a fresh clip each round. Apart from the search cache below, which is not linked to anyone, we do not keep the text the app read.
Older test versions. Test versions of the app from before the store release, which were never in the app stores, worked differently for a Spotify link: they stored the playlist's Spotify ID and name and, for up to 100 songs, each song's Spotify ID, title, artists, position, length and the web address of its 30-second Spotify clip, and they played those clips and showed artwork from Spotify's servers. While such a version is still in use, our server keeps accepting its imports. They are kept and deleted under the same rules as any other list (section 7), and "Delete my data" removes them too. If such a version hosts a game you join with the current app, the reveal of one of those songs shows an "Open in Spotify" link, without artwork; tapping it takes you to Spotify's app or website, where Spotify's own terms apply.
Checking and editing your list. Only you can see your own list. To keep the surprise, right after an import (a playlist link, screenshots or a pasted list) the app shows only how many songs it found; songs you add by searching are shown as you add them. Your list itself is under My songs on the home screen: there you see it (titles, artists and small artwork), remove songs, or search for songs that are missing (see "By searching" above). Removing a song deletes it from your newest list straight away. A game that is already running keeps the list it started with; that copy is then deleted like an older import (section 7). Looking spoils some of the surprise, which is why the app shows the list only when you open it.
Song search cache. So that the same song is not looked up at Apple again for every import, our server keeps those lookups and their results: the title and artists as looked up (simplified, for example without capitals and accents) with the ISRC if the list had one, whether the song was marked explicit, whether the length sent was under a minute, the store country, and what Apple returned. What you type in the search is not put in this cache. The cache is not linked to any player or account and holds no personal data.
Limits on adding songs. To protect our shared connection to Apple from abuse, our server records your account ID, the time and the kind of each attempt to add songs (an import from a playlist link, screenshots or a pasted list, a search, or adding one song), and refuses more than 4 imports, 30 searches or 20 added songs a minute.
Options we can switch off. We can switch the Spotify playlist link, adding songs from Apple Music's catalogue (all four ways together) and the Apple clips on or off on our server at any time, without an app update. While adding songs is off, the app does not offer it, does not read playlist pages or screenshots, and our server does not search Apple for you. While the Apple clips are off, no songs are played. Switching an option off does not delete songs you already added; section 7 says when they are deleted.
Game data. The games you host or join: the game code, who hosts it, who is in it, which song came up in each round and whose song it was, which songs, and whose, were replaced because their clip could not be loaded or left unplayed when a game ended or changed host, who you guessed, how quickly you answered, your points and your score. If a host removes you from a game, we record that so you cannot rejoin that game.
When you last used the app. The date your app last connected, so we can delete accounts that are no longer used.
Technical data. When your phone connects to our servers, our hosting provider Supabase and its network provider Cloudflare process your IP address, device and app information (the "user agent") and the times of your requests. Supabase's sign-in service keeps the IP address and device information of your current session with your account, and writes each sign-in event (such as signing in and renewing your session) with its IP address to an audit log.
Messages to us. If you email us: your email address, your message and anything you add to it, such as your player ID.
On your phone only. The app keeps your session token, your name, the code of your last game (for the "Rejoin" button) and the way you last chose to add songs in its own storage on your phone. This is removed when you use "Delete my data" or uninstall the app. When you pick screenshots, the photo picker gives the app copies of them, which the app deletes as soon as it has read them. Text you paste is held only in the app's memory while that screen is open. The app does not use an advertising ID and stores no tracking cookies. Cloudflare may set a short-lived security cookie (__cf_bm, 30 minutes) to protect our servers from bots. That cookie is strictly necessary for the service.
What we do not collect. No email address, phone number, password, contacts, location, photos, microphone audio or advertising ID, and nothing from your Spotify or Apple account. Screenshots you pick are read on your phone and never reach us. Of a playlist's page and of a list you paste, only the titles, artists, positions, explicit marks and, where the source has them, lengths and ISRCs do, never the link or the rest of the text. The app cannot access your Spotify account or your Apple Music account at all. There are no analytics, advertising, crash-reporting or tracking tools of ours in the app. The only built-in component that reports anything to its maker is Google ML Kit in the Android app (section 5).
3. Why we use it, and on what legal basis
- Running the game (account ID, name, the songs you add with a playlist link, from screenshots, from a pasted list or by search, what you type in the search, game data, last-used date). This is necessary to provide the game you ask for under our Terms of Use: GDPR Article 6(1)(b).
- Security and preventing abuse (technical data, limits on how often you can import or host, the limits on adding songs, refusing names with slurs or strong swear words, removing players from a game, handling reports, and deleting data that is no longer used). This is based on our legitimate interest in keeping the service safe, working and free of abuse: Article 6(1)(f). We use as little data as we can for this and keep it only briefly.
- Google ML Kit in the Android app (see section 5). Reading screenshots on the phone itself, instead of uploading them, keeps your pictures private. ML Kit's metrics are part of how Google provides it. As far as we are responsible for them, this is based on our legitimate interest in offering that on-device option: Article 6(1)(f). Google is responsible for its own use of the metrics. ML Kit is part of the Android app, so Google may receive them even if you never use the screenshot option, and the app has no setting to turn them off.
- App updates (see Expo in section 5). This is based on our legitimate interest in delivering bug fixes and security fixes quickly: Article 6(1)(f).
- Answering your messages and requests. This is based on our legitimate interest in helping you (Article 6(1)(f)) and on our legal duty to answer privacy requests (Article 6(1)(c)).
We do not ask for your consent for any of this, because none of it relies on consent. We do not use your data for advertising or profiling, and we never sell it. We make no automated decisions that have legal or similarly significant effects on you. Matching songs at Apple Music is automatic, but it only decides which songs are in your list, and you can correct it under My songs.
You are not legally required to give us any data. Without a name you cannot play. Without songs of your own you can still join games and guess, but none of your songs will come up.
4. Who sees what
- You see your name, your player ID and your own list. Right after an import, the app shows you only how many songs it found, so that your own songs can still surprise you; under My songs you can see the list, remove songs and add missing ones (section 8).
- Other players in your game see your name and your score. After each reveal they see who you guessed and how many points you got. Each song that plays is revealed to everyone in that game together with your name: its title, artist, Apple's artwork and a link to the song on Apple Music.
- The host's phone receives the clip of each song that is drawn, just before it plays, so it can play it out loud. It asks our server for the clip, and our server gets a fresh one from Apple and passes on only the clip's address and length. The host's phone does not receive the title, artist, artwork or link to the song before the reveal: the host sees those at the reveal, like everyone else. While a clip plays, the app only shows the line "Preview from Apple Music".
- Nobody else can browse your list, not other players and not the host. Rules in the database on the server enforce this, and they keep each song's title and artist from every phone, the host's included, until that song is revealed. Songs come out one at a time: each song that plays is revealed to everyone in that game with your name. The host's phone receives the audio clip of each drawn song, but not its title. That includes songs that are replaced because their clip cannot be loaded (at most 5 per game) and songs left unplayed when a game ends; such a song is never drawn again in that lobby. Only songs that you have higher in your list than anyone else in the game can come up.
- rezasolutions can access the database as its administrator, to run the service, answer requests and reports, and fix problems.
5. Service providers and other recipients
Supabase (our processor). Supabase runs our database, sign-in and server-side game logic, including the server functions that look up songs at Apple Music and hand the host's phone each round's clip. Our contract is with Supabase Pte. Ltd., Singapore, and our data processing agreement is part of Supabase's terms. The data is stored in the European Union, at Amazon Web Services in Ireland (region eu-west-1). The server functions for Apple Music run in the Supabase data centre nearest to the phone that uses them (in Europe, a European one) and save what they find in that database. Network traffic passes through Cloudflare. Supabase's sub-processors include Amazon Web Services and Cloudflare. Supabase's privacy policy: https://supabase.com/privacy
Expo (our processor). When the app starts, it checks Expo's update service for a newer version. Expo (650 Industries, Inc., United States) then receives your IP address, your phone's platform, the app version and a random ID for this installation. Expo receives no name, playlist or game data. Expo's privacy policy: https://expo.dev/privacy
Spotify (independent controller). Only when you add songs with a Spotify playlist link does your phone connect to Spotify: to open.spotify.com, to read the playlist's public page, and, if you paste a short link, to spotify.link and spotify.app.link (Spotify's short-link service, run for Spotify by Branch). Spotify then receives your IP address, device information and which playlist is requested, and uses that under its own privacy policy: https://www.spotify.com/legal/privacy-policy/. The app sends no cookies with these requests, does not use a Spotify account or Spotify's developer API, and has no access to your Spotify account. It loads no clips or artwork from Spotify.
Apple. Whose Song? uses Apple Music's catalogue and preview clips for every song, in two ways:
- Looking up songs. Our server sends Apple's catalogue service (the Apple Music API, which we use under our developer agreement with Apple Inc., United States) the titles and artists the app read from a playlist page or screenshots or that you pasted, the ISRCs from a pasted list and what you type in the search, to find the songs; the Apple song ID of a song you add, to check it; and in each round the Apple song ID of the song that was drawn, to get a fresh clip. These requests come from our server, not from your phone, and contain no name, account ID, IP address or anything else that identifies you or your phone. Apple therefore receives no personal data from us for this, and it is not our processor.
- Clips and artwork. The host's phone streams each song's 30-second clip directly from Apple's servers (audio-ssl.itunes.apple.com). Artwork is loaded from Apple's servers (mzstatic.com): at each reveal by every player's phone, and by your own phone when it shows search results or your list under My songs. Apple then receives that phone's IP address, device information and which clip or image is requested, and uses that as an independent controller under its own privacy policy: https://www.apple.com/legal/privacy/. For people in the European Economic Area, the UK and Switzerland, that is Apple Distribution International Limited, Ireland; elsewhere, the Apple company that policy names for your country. The app sends no cookies or account details with these requests. You do not need an Apple account or an Apple Music subscription.
- If you tap "Listen on Apple Music", you go to Apple Music's app or website, where Apple's own terms apply.
Google ML Kit (Android only, independent controller). On Android, the app reads screenshots with Google ML Kit, a text-recognition component from Google that runs on the phone. The app only asks it to read the screenshots you pick, but ML Kit is part of the Android app, and its library may start when the app starts, whether or not you use screenshots. According to Google, ML Kit processes the pictures and the text in them entirely on the phone and does not send them to Google. ML Kit does send Google its own technical metrics about its use, for diagnostics and usage analytics: device information (such as manufacturer, model, Android version and available ML hardware), the app's name and version, a per-installation identifier that Google says is not meant to identify a user or a device, performance figures (such as how long reading took), the image format and size, the size of what went in and came out, the ML Kit version, the type of event (such as starting up, reading text or shutting down) and error codes. Like any connection, this also shows Google your phone's IP address. Google encrypts the metrics in transit, says it does not pass them on to third parties, and uses them to measure, debug, maintain and improve ML Kit and to detect misuse. Google is responsible for that use under its own privacy policy: https://policies.google.com/privacy. That policy names Google Ireland Limited, Ireland, as the controller for people in the European Economic Area and Switzerland. We do not receive these metrics. On iPhone, the app uses Apple's built-in text recognition, which works entirely on the phone.
Our email provider (processor). If you email us, your message is stored by the provider of our mailbox, which handles it on our behalf.
App stores: Apple and Google (independent controllers). You download the app through the App Store or Google Play, under their own terms and privacy policies. If you allowed it in your phone's settings, they may give us overall statistics and crash reports. These do not include your name or your songs.
Nobody else. We do not sell or rent data, and we do not give it to advertisers or data brokers. We only hand data to others if the law requires it, for example because of a court order.
6. Transfers outside the European Union
The database is stored in Ireland. Supabase Pte. Ltd. is based in Singapore, which has no EU adequacy decision. Supabase's sub-processors Amazon Web Services and Cloudflare, and Expo, are based in the United States. These transfers are protected by the EU Standard Contractual Clauses (European Commission Decision (EU) 2021/914) in Supabase's and Expo's data processing terms and, for US companies certified under it, the EU–US Data Privacy Framework. You can ask us for a copy of these safeguards. Supabase's data processing agreement is published at https://supabase.com/legal/dpa
Our server's searches at Apple Inc. in the United States contain no personal data (section 5). For people in the European Economic Area, what Apple receives when a phone loads a clip or artwork is controlled by Apple Distribution International Limited in Ireland. If you use the app outside Europe, the server functions for Apple Music may run in a Supabase data centre outside the EU, under the same safeguards as above. Google may process ML Kit's metrics in the United States; Google LLC is certified under the EU–US Data Privacy Framework.
7. How long we keep it
- Older imports (from a playlist link, from screenshots or a pasted list, or started by search): deleted when you import again, unless a game you are in still uses them — then at the latest a day after you leave or are removed from that game, or it is deleted.
- Your account, name and newest import: kept until you delete them, or until your app has not connected for 180 days. Then they are deleted automatically, with everything else linked to your account.
- Games (code, players, the names copied into them, rounds, songs replaced because their clip could not be loaded or left unplayed when a game ended or changed host, guesses, scores and removals): deleted 48 hours after the game was created.
- Limit records (account ID, time and kind of each import, search or added song, for the limits on adding songs): deleted after 1 hour.
- Song search cache (not linked to anyone): deleted 90 days after the search.
- Screenshots: never on our servers. The app's copies on your phone are deleted as soon as it has read them.
- Playlist links, pasted text and searches: never stored on our servers. Only the songs that are found are kept, as part of your list.
- Sign-in records without a player (for example when setup did not finish): deleted after 7 days.
- Sign-in audit log (sign-in events with IP address and times): deleted after 7 days by the daily clean-up.
- Sign-in session records (IP address and device information of your session): kept while your session exists, and deleted with your account.
- Server logs at Supabase (IP address, device information, times): kept by Supabase for about one day.
- Update checks at Expo: kept by Expo only as long as needed to run and secure the update service.
- Emails to us: kept as long as needed to deal with your message, and no longer than 12 months after it is resolved.
- Data on your phone: until you use "Delete my data" or uninstall the app.
The automatic clean-up runs once a day, and every hour for limit records, so deletion can happen up to a day (for limit records, up to an hour) after the periods above.
8. Your rights
You have the right to access your data (GDPR Article 15), to have it corrected (Article 16) or deleted (Article 17), to restrict its use (Article 18), to receive it in a machine-readable format (Article 20), and to object to its use on the basis of our legitimate interest (Article 21).
How to use them:
- Delete everything: on the home screen, open Privacy & data and tap Delete my data. This deletes your account, name, the songs you added and your part in every game straight away. Games you are hosting end for everyone.
- Change your name: tap your name at the top of the home screen.
- See and correct your songs: tap My songs on the home screen to see your list. There you can remove songs with the ✕ or add missing ones. You can also email us for a copy.
- Anything else, or if you no longer have the app: email admin@beyondbarriers.nl and include the player ID shown under Privacy & data. If you have already removed the app, tell us the name you used, a few of the songs you added and roughly when you played, and we will try to find your data. We may ask for extra details to check that the request really comes from you. We answer within one month. If a request is complex we may need two more months; we will tell you if so. This is free.
- Complaints: you can complain to the Dutch data protection authority, the Autoriteit Persoonsgegevens (https://autoriteitpersoonsgegevens.nl), or to the authority in the EU country where you live or work. We would appreciate it if you contacted us first, so we can try to solve it.
9. Children
You must be 16 or older to use Whose Song?, or have permission from a parent or guardian if you are younger. A parent or guardian who believes their child used the app without permission can email us with the player ID (or the name the child used and roughly when), and we will delete the data.
10. Security
All connections are encrypted (HTTPS). Rules in the database (row-level security) make sure each phone can only read what it is allowed to see, and all game logic and scoring run on the server, not on the phones. Songs can only be saved by our server, which looks each one up at Apple itself, and our Apple developer key exists only there. There are no passwords to leak. Only rezasolutions has administrator access. Anyone who has your unlocked phone can use the app as you. If a data breach happens, we will take the steps the law requires, including notifying the Autoriteit Persoonsgegevens and, where needed, you.
11. Permissions
The app asks for no permissions: no microphone, camera, location, contacts, photo library or notifications. If you add songs from screenshots, you pick them in your phone's own photo picker. That needs no permission: the app receives only the pictures you pick, not the rest of your photos. On Android the app only uses normal permissions that are granted automatically when you install it: internet access, network state (to see whether there is a connection) and audio settings (to play the clips). Sound only plays while the app is open.
12. Changes to this policy
The date at the top shows the current version. We announce important changes in the app or on this page before they take effect. Earlier versions are available on request.
