1. Wie wij zijn

Whose Song? is een partyspel-app van rezasolutions, Nederland ("wij", "ons"). Contact: admin@beyondbarriers.nl

De app is gratis. Er zitten geen advertenties en geen in-app-aankopen in.

2. Akkoord met deze voorwaarden

Door de app te gebruiken ga je akkoord met deze voorwaarden. Ben je het er niet mee eens, gebruik de app dan niet. In onze privacyverklaring lees je hoe we met je gegevens omgaan: https://whosesong.beyondbarriers.nl/privacy/

Je moet 16 jaar of ouder zijn om de app te gebruiken. Ben je jonger, dan mag je de app alleen gebruiken met toestemming van een ouder of voogd.

3. Je account

  • Zodra je voorbij het eerste scherm gaat, maakt de app automatisch een account voor je aan. Dat heeft geen e-mailadres of wachtwoord en hoort bij de telefoon die je gebruikt.
  • Je kunt je account niet naar een andere telefoon meenemen. Verwijder je de app of wis je de gegevens ervan, dan ben je het account kwijt en kunnen wij het niet terughalen.
  • Je kunt je account altijd verwijderen: open op het startscherm Privacy & data en tik op Delete my data. Daarmee worden je account en gegevens meteen gewist en stopt elk spel dat jij host.
  • Accounts die 180 dagen niet gebruikt zijn, worden automatisch verwijderd.
  • Beveilig je telefoon: wie je ontgrendelde telefoon gebruikt, kan als jou spelen.

4. Eerlijk gebruik

Als je Whose Song? gebruikt, spreek je het volgende af.

  • Namen. Kies een naam die niet beledigend, haatdragend, seksueel, discriminerend of bedreigend is. Doe je niet voor als iemand anders, en zet geen persoonsgegevens van anderen in een naam (zoals de volledige naam, het telefoonnummer of het adres van iemand die niet meespeelt). De app houdt namen met grove scheldwoorden of vloeken tegen, maar geen filter vangt alles, dus dit blijft jouw verantwoordelijkheid; in paragraaf 5 staat wat er gebeurt als een naam zich niet aan deze regel houdt.
  • Playlists, screenshots en lijsten met nummers. Gebruik alleen links naar playlists die je mag delen: je eigen playlists, of playlists die openbaar zijn. Voeg je nummers toe uit screenshots of door een lijst te plakken, gebruik dan alleen je eigen lijsten met nummers. Je bent zelf verantwoordelijk voor de nummers die je toevoegt.
  • Geen misbruik. Gebruik geen bots, scripts of andere automatisering; probeer geen spelcodes te raden of massaal uit te proberen; stuur geen overmatig aantal verzoeken; probeer geen beveiliging, limieten of een verwijdering uit een spel te omzeilen; lees geen gegevens die niet voor jou bedoeld zijn; en verstoor geen spellen van anderen.
  • Alleen legaal gebruik. Gebruik de app niet voor iets wat verboden is of om anderen lastig te vallen.

5. Moderatie en meldingen

  • Beledigende namen worden automatisch tegengehouden: kies of wijzig je je naam, dan weigert onze server die als er een grof scheldwoord of een grove vloek in het Engels of Nederlands in staat, en word je gevraagd een andere naam te kiezen. Namen zijn alleen te zien voor de spelers in hetzelfde spel.
  • De host van een spel kan een speler verwijderen. Een verwijderde speler kan niet opnieuw in dat spel.
  • We kunnen namen verwijderen, spellen beëindigen, of accounts blokkeren of verwijderen die deze voorwaarden overtreden, of als dat nodig is om andere spelers of de dienst te beschermen. We doen dat zorgvuldig en in verhouding. Als we je kunnen bereiken, laten we je weten wat we gedaan hebben en waarom.
  • Wil je een naam, een speler of een probleem melden? Gebruik Report a problem onder Privacy & data in de app, of mail naar admin@beyondbarriers.nl. Vermeld zo mogelijk de spelcode, de naam waar het om gaat en wat er gebeurde. We bekijken elke melding zo snel als redelijkerwijs kan.

6. Spotify, Apple Music en content van anderen

  • Whose Song? zoekt elk nummer dat je toevoegt op in de catalogus van Apple Music, of je het nu toevoegt met een link naar een openbare Spotify-playlist, uit screenshots van je lijsten met nummers, uit een lijst die je plakt of door te zoeken. Van een Spotify-playlist leest de app alleen de namen en gegevens van de nummers op de openbare pagina van de playlist; ze gebruikt je Spotify-account niet en speelt niets af van Spotify. Whose Song? is niet verbonden aan, goedgekeurd door, gesponsord door of gelieerd aan Spotify of Apple. Spotify is een merk van Spotify AB. Apple en Apple Music zijn merken van Apple Inc., geregistreerd in de VS en andere landen.
  • Nummers, fragmenten van 30 seconden, titels en hoesafbeeldingen zijn van hun rechthebbenden. De fragmenten van 30 seconden en de hoesafbeeldingen worden geleverd door Apple Music en rechtstreeks van Apple geladen op de telefoons in het spel. Tik je op "Listen on Apple Music", dan gelden de voorwaarden van Apple. Je hebt geen Apple Music-abonnement of Spotify-account nodig.
  • Wij bewaren geen audio of afbeeldingen. De fragmenten zijn alleen om het spel te spelen: neem ze niet op, download of bewaar ze niet en geef ze niet door.
  • Het lezen van playlistlinks, het opzoeken van nummers in de catalogus van Apple Music en het afspelen van fragmenten hangen af van Spotify en Apple en kunnen op elk moment stoppen, tijdelijk of voorgoed. We kunnen ze ook zelf uitzetten, bijvoorbeeld als Spotify of Apple ons daarom vraagt. We kunnen niet garanderen dat ze blijven werken.
  • Het spel is bedoeld voor besloten bijeenkomsten met vrienden en familie. Gebruik het niet om muziek te draaien in openbare of commerciële omgevingen, zoals cafés, winkels, evenementen, uitzendingen of livestreams. Daarvoor zijn muzieklicenties nodig die de app niet biedt.

7. Onze rechten op de app

De app, met de code, het ontwerp, de naam en het logo, is © rezasolutions. Alle rechten voorbehouden. We geven je een persoonlijke, niet-exclusieve, niet overdraagbare licentie, die we kunnen intrekken, om de app voor privé- en niet-commerciële doeleinden te gebruiken volgens deze voorwaarden en de regels van de appwinkel waar je de app vandaan hebt. Je mag de app niet kopiëren, verkopen of verder verspreiden, en ook niet terugvertalen naar broncode (reverse engineering), behalve voor zover de wet dat uitdrukkelijk toestaat.

De rechten die je hebt op je naam en je lijst met nummers houd je. Je geeft ons het recht (een licentie) om ze op te slaan en aan de andere spelers in je spellen te tonen, voor zover dat nodig is om het spel te laten werken.

8. Beschikbaarheid en wijzigingen

  • We bieden de app aan "zoals hij is" en "zoals beschikbaar". We doen ons best om hem werkend te houden, maar beloven niet dat hij altijd beschikbaar of foutloos is.
  • We kunnen de app op elk moment wijzigen, bijwerken (ook met automatische updates van de inhoud van de app), pauzeren of stoppen. Stoppen we met de dienst, dan worden je gegevens gewist zoals beschreven in de privacyverklaring.
  • We kunnen deze voorwaarden wijzigen. De datum bovenaan geeft de huidige versie aan. Belangrijke wijzigingen kondigen we vooraf aan in de app of op deze pagina. Gebruik je de app daarna nog, dan gelden de nieuwe voorwaarden. Ben je het er niet mee eens, stop dan met de app en wis je gegevens.

9. Aansprakelijkheid

De app is gratis en wordt aangeboden zoals hij is. Voor zover het Nederlandse recht dat toestaat, zijn we niet aansprakelijk voor schade door het gebruik van de app of doordat je de app niet kunt gebruiken, door verloren spelgegevens, of door diensten van anderen, zoals Spotify, Apple of Google.

Dit beperkt geen aansprakelijkheid die volgens het Nederlandse recht niet beperkt mag worden, zoals aansprakelijkheid voor schade door onze opzet of bewuste roekeloosheid. Niets in deze voorwaarden tast je dwingende rechten als consument aan, waaronder de bescherming van de artikelen 6:236 en 6:237 van het Burgerlijk Wetboek.

10. Voorwaarden van de appwinkels

Heb je de app uit de App Store van Apple gedownload, dan geldt ook de standaard-licentieovereenkomst van Apple (Licensed Application End User License Agreement): https://www.apple.com/legal/internet-services/itunes/dev/stdeula/

Heb je hem uit Google Play gedownload, dan gelden ook de Servicevoorwaarden van Google Play: https://play.google.com/about/play-terms/

Apple en Google zijn geen partij bij deze voorwaarden en zijn niet verantwoordelijk voor de app of de inhoud ervan.

11. Toepasselijk recht en geschillen

Op deze voorwaarden is Nederlands recht van toepassing. Heb je een klacht, neem dan eerst contact met ons op, zodat we kunnen proberen het samen op te lossen. Geschillen worden voorgelegd aan de bevoegde rechter in Nederland. Woon je als consument elders in de EU, dan houd je ook de bescherming van het dwingende recht van je eigen land, en mag je een zaak voorleggen aan de rechter van je woonplaats.

Blijkt een deel van deze voorwaarden ongeldig, dan blijft de rest gewoon gelden.

1. Who we are

Whose Song? is a party game app provided by rezasolutions, the Netherlands ("we", "us"). Contact: admin@beyondbarriers.nl

The app is free. It has no ads and no in-app purchases.

2. Accepting these terms

By using the app you agree to these terms. If you do not agree, please do not use the app. Our Privacy Policy explains how we handle your data: https://whosesong.beyondbarriers.nl/privacy/

You must be 16 or older to use the app. If you are younger, you may only use it with permission from a parent or guardian.

3. Your account

  • When you continue past the first screen, the app creates an account for you automatically. It has no email address or password and is tied to the phone you use.
  • You cannot move your account to another phone. If you uninstall the app or clear its data, the account is lost and we cannot restore it.
  • You can delete your account at any time: on the home screen, open Privacy & data and tap Delete my data. This deletes your account and data straight away and ends any game you are hosting.
  • Accounts that are not used for 180 days are deleted automatically.
  • Keep your phone secure: anyone who uses your unlocked phone can play as you.

4. Using the app fairly

When you use Whose Song?, you agree to the following.

  • Names. Choose a name that is not offensive, hateful, sexual, discriminatory or threatening. Do not pretend to be someone else, and do not put other people's personal details in a name (such as a full name, phone number or address of someone who is not playing). The app blocks names with slurs or strong swear words, but no filter catches everything, so this is still up to you; section 5 says what happens when a name breaks this rule.
  • Playlists, screenshots and song lists. Only use links to playlists you are entitled to share: your own, or playlists that are public. If you add songs from screenshots or by pasting a list, only use your own song lists. You are responsible for the songs you add.
  • No abuse. Do not use bots, scripts or other automation; do not try to guess or brute-force game codes; do not send excessive requests; do not try to get around security measures, limits or a removal from a game; do not read data you are not meant to see; and do not disrupt other people's games.
  • Lawful use only. Do not use the app for anything illegal or to harass other people.

5. Moderation and reports

  • Offensive names are blocked automatically: when you choose or change your name, our server refuses it if it contains a slur or a strong swear word in English or Dutch, and you are asked to choose a different name. Names are shown only to the players in the same game.
  • The host of a game can remove a player. A removed player cannot rejoin that game.
  • We may remove names, end games, or block or delete accounts that break these terms, or when that is needed to protect other players or the service. We act carefully and proportionately. Where we can reach you, we tell you what we did and why.
  • To report a name, a player or a problem, use Report a problem under Privacy & data in the app, or email admin@beyondbarriers.nl. If you can, include the game code, the name involved and what happened. We look at every report as soon as we reasonably can.

6. Spotify, Apple Music and other people's content

  • Whose Song? finds every song you add in Apple Music's catalogue, whether you add it with a link to a public Spotify playlist, from screenshots of your song lists, from a song list you paste, or by searching. From a Spotify playlist, the app only reads the songs' names and details on the playlist's public page; it does not use your Spotify account and plays nothing from Spotify. Whose Song? is not affiliated with, endorsed by, sponsored by or connected to Spotify or Apple. Spotify is a trademark of Spotify AB. Apple and Apple Music are trademarks of Apple Inc., registered in the U.S. and other countries.
  • Songs, 30-second clips, titles and artwork belong to their rights holders. The 30-second previews and the artwork are provided by Apple Music and load directly from Apple to the phones in the game. If you tap "Listen on Apple Music", Apple's own terms apply. You do not need an Apple Music subscription or a Spotify account.
  • We do not store audio or artwork. The clips are only for playing the game: do not record, download, save or pass them on.
  • Reading playlist links, finding songs in Apple Music's catalogue and playing clips depend on Spotify and Apple and may stop working at any time, temporarily or for good. We may also switch any of them off ourselves, for example if Spotify or Apple asks us to. We cannot guarantee that they keep working.
  • The game is meant for private get-togethers with friends and family. Do not use it to play music in public or commercial settings, such as bars, shops, events, broadcasts or live streams. Those need music licences that the app does not provide.

7. Our rights in the app

The app, including its code, design, name and logo, is © rezasolutions. All rights reserved. We give you a personal, non-exclusive, non-transferable licence, which we can withdraw, to use the app for private, non-commercial purposes in line with these terms and the rules of the app store you got it from. You may not copy, sell or redistribute the app, or reverse engineer it, except where the law expressly allows that.

You keep whatever rights you have in your name and your song list. You allow us to store them and show them to the other players in your games, as far as needed to run the game.

8. Availability and changes

  • We provide the app "as is" and "as available". We do our best to keep it working, but we do not promise that it is always available or free of errors.
  • We may change the app, update it (including automatic updates to the app's content), pause it or stop it at any time. If we stop the service, your data is deleted as described in the Privacy Policy.
  • We may change these terms. The date at the top shows the current version. We announce important changes in the app or on this page before they take effect. If you keep using the app after that, the new terms apply. If you do not agree, stop using the app and delete your data.

9. Liability

The app is free and provided as is. As far as Dutch law allows, we are not liable for damage caused by using the app or by not being able to use it, by lost game data, or by third-party services such as Spotify, Apple or Google.

This does not limit any liability that cannot be limited under Dutch law, including liability for damage caused by our intent or deliberate recklessness. Nothing in these terms takes away your mandatory rights as a consumer, including the protection of Articles 6:236 and 6:237 of the Dutch Civil Code.

If you downloaded it from Google Play, the Google Play Terms of Service also apply: https://play.google.com/about/play-terms/

Apple and Google are not parties to these terms and are not responsible for the app or its content.

11. Law and disputes

Dutch law applies to these terms. If you have a complaint, please contact us first, so we can try to solve it together. Disputes go to the competent court in the Netherlands. If you are a consumer living elsewhere in the EU, you also keep the protection of the mandatory law of your country, and you may bring a case before the court where you live.

If any part of these terms turns out to be invalid, the rest still applies.
